In Al-Bassiouni v. Prime Minister, the Supreme Court of Israel held that since the disengagement in 2005, Israel does not have ‘effective control’ over the Gaza Strip. Because of the importance of this conclusion, the actual wording of the Supreme Court is cited below:
‘… since September 2005 Israel no longer has effective control over what happens in the Gaza Strip. Military rule that applied in the past in this territory came to an end by a decision of the government, and Israeli soldiers are no longer stationed in the territory on a permanent basis, nor are they in charge of what happens there. In these circumstances, the State of Israel does not have a general duty to ensure the welfare of the residents of the Gaza Strip or to maintain public order in the Gaza Strip according to the laws of belligerent occupation in international law. Neither does Israel have any effective capability, in its present position, of enforcing order and managing civilian life in the Gaza Strip.’
In its judgment, the Supreme Court further held that the main obligations imposed on the State of Israel vis-à-vis the inhabitants of the Gaza Strip derive from the existence of an armed conflict between Israel and the Hamas organization; the degree of control exercised by the State of Israel over the border crossings between it and the Gaza Strip; and the relationship of dependency that was created – at least in certain spheres, such as the electricity supply to the Gaza Strip – during the long period of military rule in the Gaza Strip.
A crowd of angry Palestinians protesters on Friday mobbed the car of French Foreign Minister Michele Alliot-Marie as she arrived in Gaza, an AFP correspondent said.
Some demonstrators hurled shoes at the car and one jumped on top of it in a protest over a statement which was mistakenly attributed to the French minister when she met with the parents of captive Israeli soldier Gilad Shalit in Jerusalem a day earlier.
Oddly enough, the article above, by YnetNews, doesn’t mention what the mistaken statement was.
Personally, I think an angry Israel mob should protest that the French Foreign Minister does not think that the treatment of Shalit qualifies as a war crime.
Once again, international law is only invoked when it can be applied against Israel.
What is time thinking. Unless they have totally lost there minds if just might be the dhimitude talking. It is a sad day. Didn’t they used to stand for the forces of good instead of evil?

It seems Israel is not doing what it needs to to destroy jihadis. I do not think the Hamas jihadis need any chance. Destroy them first or at least when they attack you. I don’t understand Israel not responding.

(ANSAmed) – GAZA, JANUARY 14 – Hamas leaders are committed to a systematic ”witch hunt” and 150 women were arrested in 2010 in Gaza for having made recourse to witchcraft of some sort. During a symposium held in recent days in Gaza, it was stated that in the eyes of Hamas, the activities of these women represent a real social danger, also because they risk ”breaking up families,” causing divorce and frittering away of money. Sometimes their activities also have criminal repercussions. One awareness campaign against ”the witches” was launched using large posters in mosques, universities and public offices frequented by women.
The issue emerged again in August last year when a 62-year-old woman, Jabryieh Abu Ghanas, considered to be active in the field of ”witchcraft” and the production of ”voodoo dolls”, was shot dead in a street in the centre of Gaza. This murder caused great alarm in the Palestinian human rights defence organisations al-Mezan and Pchr-Gaza. It seems however that for now Hamas are not using an iron hand in regard to the women suspected of witchcraft. They are forced to sign an undertaking to abandon their practices, consider incompatible with Islam, for good. It seems this measure has been sufficient and to date there is no news of any ”witch” being imprisoned by Hamas.

“The situation in Gaza has to change,” Cameron said Tuesday during a speech to a Turkish business association in Ankara. “Humanitarian goods and people must flow in both directions. The Israeli assault on Gaza in December 2008 and January 2009 inflicted high levels of stress and insecurity on its Palestinian population, a study published by The Lancet on Friday said.
The paper in the peer-reviewed British journal provides statistical backing for doctors who say the operation — in addition to killing around 1,400 Palestinians and injuring thousands more — left deep psychological scars.
Public health researchers led by Niveen Abu-Rmeileh of Birzeit University in the West Bank carried out a survey of around 3,000 Gazan households, numbering nearly 18,000 people, six months after the conflict.
Eighty-five percent of respondents reported moderate or high levels of insecurities, fears and threats, and 49 percent said they had moderate or high levels of distress.
I suppose having thousands of rockets fired at them–not to mention decades of terrorist attacks–caused Israelis to have elevated stress levels too, but the researchers didn’t seem interested in that. No doubt living under Hamas can also make one a little jumpy, but that didn’t make its way into the medical journal, either.
Generating “data” to support left-wing talking points is a well-funded industry. But no matter how many such propaganda pieces are published, it is obvious to any sentient being that what Gaza and the West Bank need is to get rid of Hamas and other terrorist groups and abandon their genocidal designs on Israel. If that ever happens, the stress level in the region will decline precipitously.”
